Thank you for choosing EQ Flow, a product of Astrolabe Labs LLC ("we," "our," or "the Service"). These Terms of Service ("Terms") govern your access to and use of EQ Flow's emotional wellness platform, including our website, mobile applications, and all related services.

By accessing or using EQ Flow, you agree to be bound by these Terms. If you don't agree to these Terms, please don't use our Service.

1.1 What EQ Flow Does

EQ Flow provides tools and features to help you:

Track your emotions — daily check-ins to monitor your emotional state over time
Discover patterns — AI-powered analysis to identify emotional trends and triggers
Build awareness — insights and visualizations of your emotional landscape
Practice wellness — guided meditations, journaling, and exercises
Set visions — define the felt sense of the state you want to live from
Track growth — progress monitoring across all dimensions
Genomic optimization — upload raw DNA data to receive personalized supplement suggestions and health insights based on your genetic variants
Supplement tracking — daily supplement checklists generated from your genomic profile, with adherence tracking

1.2 What EQ Flow Is NOT

EQ Flow is not a medical device, mental health treatment service, or clinical diagnostic tool.

We do not provide medical advice, diagnosis, or treatment
We are not a substitute for professional mental health care
Our AI insights are suggestions, not clinical recommendations
No doctor-patient relationship is created by using our Service
Supplement suggestions are informational only — they are not prescriptions, not clinically validated, and not reviewed by a licensed healthcare provider
Genomic insights are not a substitute for clinical genetic testing or genetic counseling
Drug interaction alerts are informational and not comprehensive — they do not replace review by a pharmacist or prescriber

🛡 Data Encryption

We take your privacy seriously. Your sensitive data is protected through AES-256-GCM encryption:

Journal entries, check-in notes, vision plans, and meditation reflections are encrypted with your personal encryption key
Your encryption key is derived from your account and is unique to you
We cannot access, read, or recover your encrypted content

2.2 What We Store

Encrypted (private to you):

Journal entries and personal notes
Free-text content in check-ins
Vision planning details
Meditation session reflections
Sensitive AI analysis fields (insights, alignment notes)

Not encrypted (used to provide the service):

Emotional intensity ratings (1-10 scale)
Selected emotions from our predefined taxonomy
Check-in timestamps and frequency
Context categories (work, relationships, health, etc.)
Somatic awareness data (breathing, body, mind, energy scales)
Account information (email, name)

2.3 AI Processing

We use Anthropic's Claude AI to provide personalized insights:

Your emotional patterns and context are temporarily processed for analysis
Personal identifiers, credentials, and payment information are never sent to AI
Anthropic does not use your data to train their models and does not retain it beyond processing
User identifiers are anonymized via SHA-256 hashing before AI logging

2.4 Data Ownership & Deletion

You own your data — all emotional data, insights, and content you create belongs to you
Export all your data anytime from Settings
Request account deletion and all data will be permanently removed within 30 days
We recommend exporting your data regularly as a personal backup

3.1 Account Creation

You must be at least 18 years old to use EQ Flow
You must provide accurate, current information
You are responsible for maintaining account security
You may not share your account with others
One person per account (no shared accounts)

3.2 Acceptable Use

You agree NOT to:

Use the Service for any illegal purpose
Impersonate others or provide false information
Harass, abuse, or harm other users
Attempt to hack, reverse engineer, or compromise the Service
Use automated tools (bots, scrapers) without permission
Sell, resell, or commercialize the Service

3.3 Account Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent or illegal activity, or abuse the Service. You may close your account at any time from Settings.

4.1 Free Features

EQ Flow offers core features for free, including unlimited daily check-ins, emotional tracking, AI insights, meditation library, journaling, and vision planning.

4.2 Premium Features

Premium subscriptions may offer additional features such as advanced AI analysis, expanded content library, extended data history, and priority support.

4.3 Billing & Cancellation

Subscriptions renew automatically unless canceled
Prices are stated in USD and may change with notice
You may cancel your subscription at any time
Access to premium features continues until the end of your billing period
No refunds for partial billing periods

5.1 Our Content

EQ Flow's platform, design, code, features, audio content, and branding are owned by Astrolabe Labs LLC and protected by copyright, trademark, and other intellectual property laws.

5.2 Your Content

You retain ownership of all emotional data and content you create
You grant us a license to process your data solely to provide the Service
We will not sell or share your content with third parties for marketing
Aggregated, anonymized data may be used for research and service improvement

5.3 Feedback

If you provide suggestions, ideas, or feedback, we may use them to improve the Service without obligation or compensation.

6.1 Service "As Is"

EQ Flow is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee the Service will be error-free, secure, or always available.

6.2 Health Disclaimer

EQ Flow is a wellness tool, not medical advice. Always consult qualified healthcare professionals for mental health concerns. We are not liable for any decisions made based on insights from our Service.

6.3 Supplement & Genomic Optimization Disclaimer

Supplement suggestions generated by EQ Flow are for informational and educational purposes only.

Supplement protocols are generated by a deterministic rules engine based on published genetic variant research — they are not AI-generated, not clinically validated, and not reviewed by a licensed healthcare provider before being presented to you
These statements have not been evaluated by the Food and Drug Administration (FDA). This product is not intended to diagnose, treat, cure, or prevent any disease
Supplement suggestions do not account for your existing medications, medical conditions, allergies, pregnancy or nursing status, or other individual health factors that only a qualified healthcare provider can evaluate
You should always consult with a physician, pharmacist, or other qualified healthcare professional before starting, stopping, or changing any supplement, medication, or health regimen
Astrolabe Labs LLC is not responsible for any adverse effects, drug interactions, or health consequences resulting from supplement use based on information provided by the Service

ASSUMPTION OF RISK.

By accessing or using the supplement suggestion feature, you expressly acknowledge and assume all risks associated with purchasing, consuming, or otherwise relying on any dietary supplements suggested by the Service. You understand that:

Dietary supplements may interact with prescription medications, over-the-counter drugs, other supplements, or pre-existing medical conditions in ways that are harmful or unpredictable
The Service does not have access to your complete medical history, current medications, allergies, or individual health status
Supplement suggestions are generated from a deterministic rules engine based on published genetic research and do not account for your complete health profile
You are solely responsible for consulting with a qualified healthcare provider before starting, stopping, or modifying any supplement regimen
Astrolabe Labs LLC, its officers, employees, and affiliates shall not be held liable for any adverse health effects, allergic reactions, drug interactions, or other consequences resulting from your decision to purchase or consume supplements based on information provided by the Service

6.4 Pharmacogenomic & Drug Interaction Disclaimer

Drug interaction and pharmacogenomic alerts provided by EQ Flow are informational only and are not comprehensive.

Drug metabolism insights (e.g., CYP enzyme variants, transporter gene variants) are based on published research but do not constitute clinical pharmacogenomic testing
The Service does not have access to your complete medication list and cannot detect all possible drug-gene or drug-drug interactions
Interaction alerts do not replace consultation with a pharmacist, prescribing physician, or clinical pharmacogenomics specialist
Never adjust, start, or stop any medication based solely on information from this Service

6.5 Third-Party Services

We use third-party services (AI processing, authentication, hosting). We are not responsible for their performance, availability, or policies.

6.6 Limitation of Liability

To the maximum extent permitted by law, Astrolabe Labs LLC and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including but not limited to loss of data, loss of profits, or damages arising from reliance on any content or insights provided by the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF ASTROLABE LABS LLC ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100.00) OR (B) THE TOTAL AMOUNT YOU HAVE PAID TO ASTROLABE LABS LLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

6.7 Indemnification

You agree to indemnify, defend, and hold harmless Astrolabe Labs LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Service, including any supplement, health, or lifestyle decisions made based on information provided by the Service
Your violation of these Terms
Your violation of any rights of another party
Your sharing of genetic, health, or supplement information obtained through the Service with any third party
Any claim that your use of information from the Service caused harm to you or any third party

This indemnification obligation shall survive termination of your account and these Terms.

7.1 Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notification. Continued use after changes constitutes acceptance of the updated Terms.

7.2 Changes to Service

We may modify, suspend, or discontinue features at any time with or without notice. We will make reasonable efforts to notify you of significant changes.

7.3 Service Availability

We reserve the right to suspend or terminate the Service for maintenance, legal requirements, or business reasons. We will provide advance notice when reasonably possible.

8.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law provisions.

8.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association.

You and Astrolabe Labs LLC agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, collective, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against Astrolabe Labs LLC. If for any reason a claim proceeds in court rather than arbitration, you and Astrolabe Labs LLC each waive any right to a jury trial.

8.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

8.4 Assignment

Astrolabe Labs LLC may assign or transfer these Terms, and any rights and licenses granted herein, to a third party without restriction or notification. You may not assign or transfer these Terms or any rights herein without the prior written consent of Astrolabe Labs LLC.

8.5 Force Majeure

Astrolabe Labs LLC shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, pandemics, or disruptions to third-party services upon which the Service depends.

8.6 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Astrolabe Labs LLC regarding the Service and supersede all prior agreements.

8.7 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
